Consultation Phase

During the Consultation Phase the Deed Administrators, via the LAS Team, liaised with nominated property owners regarding their eligibility to participate in the LAS. 

The Consultation Phase commenced on 4 April 2011 and concluded on 31 July 2011. 


What is a nominated property?

In 1995, a Commission of Inquiry identified a number of properties, as part of the development consent issued by the Minister for Urban Affairs and Planning in relation to PCCS’s operations.

Properties which were identified by the 1995 Commission of Inquiry may be eligible to participate in the LAS.  Essentially, all properties are located within boundary indicated on the below map are nominated properties and may be eligible to participate in the LAS.

 


How will I know if my property is a nominated property?

The Deed Administrators have been provided with a schedule of nominated properties by the LMCC. 

The Deed Administrators wrote to property owners of nominated properties advising that their property may be eligible to participate in the LAS and inviting them to confirm their interest in participating.


What makes a property eligible to participate in the LAS?

To be eligible to participate in the LAS your property must be a residential property or used predominantly for residential purposes.

The following properties are not eligible to participate in the LAS:

  • Non residential properties (i.e. properties that are not zoned residential or occupied predominantly for residential purposes)
  • PCCS owned properties
  • Formerly PCCS owned properties
  • Vacant land
  • Public land

How do I agree to participate in the LAS?

The Consultation phase of the LAS concluded on 31 July 2011.

Accordingly, no further properties will be admitted into the LAS.

Property owners can withdraw from the LAS at any stage by notifying the LAS Team in writing.


What if I do not want to participate in the LAS?

The LAS is a voluntary, opt in program.  If a property owner chooses not to participate, then PCCS will be under no further obligation with respect to that property.  Failure to respond to correspondence from the LAS Team within the specified period of time will be treated as a decision to not participate in the LAS.
