
The Sampling Phase commenced on 1 August 2011 however in some cases sampling work commenced prior to the conclusion of the Consultation Phase.
The Sampling Phase is drawing to a close. Eligible participants who have correctly completed a participation agreement but have not yet had samples taken from their properties are requested to immediately contact the LAS Team to arrange a suitable time for an authorised representative to attend the property to take samples.
The authorised representative will select five (5) areas of bare soil or grassed areas within the participant’s yard (where possible) and take five (5) soil samples from each of the selected areas. The soil samples will be approximately 50mm deep and 50mm wide.
The LAS does not include flower beds, driveways, sealed areas, outhouses, sheds or dwellings or soils within a two metre proximity to buildings.
The sampling technique that will be used is in accordance with the procedure endorsed by the NSW Environment Protection Authority (“EPA”) in the 1995 Pasminco development consent.
The authorised representative will also ask the participant some questions in respect of the history of the property, specifically in respect of any previous abatement works or construction at the property.
Where a tenant is occupying the property, participants will be contacted by the authorised representative to discuss the history of the property.
The samples will measure the average lead levels (parts per million “ppm”) within the surface soil in bare soil and grassed areas.
The samples will be sent to an independent laboratory for analysis. The independent laboratory will analyse the samples and provide a report on the average ppm lead content.
The sampling results will be provided in a report to the participant, the DOP, the DECCW and the LMCC.
Residents will receive a report outlining the sampling results for their property in due course once sampling result shave been obtained and certified.
The results will be categorised into result ranges based on the average sample results of the lead levels within the soil, this will determine the level of works required. Below is a table of the result categories and respective works.

The LAS team will write to the participant and advise of the level of works to be completed at the property.
Prior to any work commencing at the property, the participant must confirm in writing that they agree to the proposed works.
The LAS team is endeavouring to provide the sampling results to residents as they are available. However, with a large number of participants and a stringent certification process, there may be some delay in participants receiving their results.
If you do not agree with the proposed works, please contact the LAS Team to discuss your concerns. You may be asked to provide your concerns in writing so that the LAS Team are able to respond to you formally.
Alternatively, you can choose to carry out your own work at your own expense and make arrangements with the LAS team to deposit the contaminated material in the site containment cell prior to its closure.
Please note that only the above works relevant to the appropriate sample result range will be conducted under the LAS. Participants who wish to undertake additional works do so at their own cost.
The LAS is a voluntary, opt in, program. Participants are permitted to withdraw from the LAS at any stage. Participants who no longer wish to participate in the LAS are required to notify the LAS Team in writing.
